The EB-5 Investor Visa Program is a great way to offer a bright future to your family while investing in the United States economy and creating jobs for U.S. residents and families.

WHAT IS THE EB-5 INVESTOR VISA PROGRAM?

The EB-5 Immigrant Investor Visa is a U.S. government program that encourages new investment in job-creating businesses. By making an eligible EB-5 investment that creates at least 10 new U.S. jobs, the foreign investor and his or her immediate family are eligible to receive permanent U.S. residency and immigrate to the U.S.

Significant Changes
to the EB-5 Program

In March 2022, Congress enacted the EB-5 Reform and Integrity Act of 2022 (the "RIA"), which reauthorized and revamped the system governing regional centers — entities that pool investments from foreign visa applicants to promote job growth in the United States.

The RIA made the EB-5 Immigrant Investor Program more attractive to investors by strengthening the program in several ways:

1) Increased Oversight- To align with RIA requirements, our Regional Center projects will all employ a third-party fund administrator. This third-party fund administrator will co-sign all EB-5 fund disbursements and review developer draw requests, ensuring the safety of your EB-5 funds. 

2) Processing Times- Under the RIA, Congress has directed USCIS to decrease I-526E processing times. Specifically, Congress intends for all I-526E petitions to be adjudicated within 240 days, whether or not the project is located in a Targeted Employment Area (TEA). 

3) Concurrent Filing- Under the RIA, certain EB-5 investors may move to the U.S. faster than ever before. See below to learn more about Concurrent Filing.

EB-5 Investors can take advantage of "Concurrent Filing" and move to the U.S. quicker than ever before!

              "Concurrent Filing" is the most beneficial change in the updated EB-5 laws. For the first time, EB-5 investors present in the U.S. on non-immigrant visas may apply for adjustment of status (form I-485) at the same time as they apply to become an investor (form I-526). Previously, investors needed to wait until their I-526's were approved--sometimes up to two years before they can live in the U.S. as a conditional resident. Now an investor present in the U.S. can immediately file and remain in the U.S. while their conditional residency is pending. While present, investors are also entitled to receive a work and travel permit.

The EB-5 for Florida Regional Center management team is an extremely experienced group of attorneys, real estate development and professionals.

 

With over fifty years of combined experience in immigration law, real-estate development and fund management, our management team is well prepared to face the challenges of the EB5 program. The management team of our Regional Center has been involved with more than a dozen successful EB-5 projects and has contributed to the successful development of restaurants, hotels and office buildings throughout the State of Florida

 

The Management team and Principles of our Regional Center have also successfully assisted hundreds of families in obtaining permanent residency in the United States through the EB-5 Visa program.

 

The EB5 For Florida Regional Center shall oversee administrative matters involving the maintenance and compliance of the Projects it sponsors under USCIS guidelines and shall assist Investing Members in providing information with respect to the processing of the I-526 Petitions and the issuance of the I-829 Petition approvals that will eventually be required for Investing Members to obtain permanent residency status.

 

In particular, the Regional Center shall provide necessary information with respect to job creation and confirmation of expenditure of funds to support each Investing Member's I-526 Petition and I-829 Petition.

 

It is the responsibility of the Regional Center to properly monitor the use of the investors' funds and to ensure that the business in which the money has been invested complies with all rules and regulations of the EB-5 Visa program.

ROGER A. BERNSTEIN

As an expert in immigration law, representing the diverse interests of foreign investors, and highly knowledgeable of real estate development, Roger Bernstein brings the essential experience to assess the viability of EB-5 investor visa projects that will result in the desired immigrant visas. 

 

Mr. Bernstein has counseled Regional Centers on projects valued at more than $100 Million, many of which have received Exemplar Project Approval. His more than twenty years of experience has resulted in a strong record of I-526 and I-829 approvals. 

 

Mr. Bernstein has also successfully acquired non-immigrant visas and residency for hundreds of individuals who desired to live and work in the United States and has represented Fortune 500 and large privately-held companies. Roger Bernstein co-founded Bernstein Osberg-Braun PL, a highly respected and widely recognized immigration law firm.

 

He is a graduate of Brown University and the University of Miami School of Law. He is admitted to practice law in Florida, the 11th Circuit Court of Appeals, and the Supreme Court of the United States and is Board Certified by the Florida Bar as an expert in Immigration and Nationality Law.

LINDA OSBERG-BRAUN

Linda Osberg-Braun is a partner and co-founder of Bernstein Osberg-Braun PL, a highly respected and widely recognized immigration law firm. Drawing on her many years of high level government service, Ms. Osberg-Braun valued immigration experience also extends to the EB-5 Investor Visa Program.

 

Ms. Osberg has counseled investors from many countries on a wide variety of issues in both regional center-affiliated projects as well as stand alone petitions. Her clientele have come from Europe, Asia, Central and South America.

 

Linda Osberg-Braun is Board certified by the Florida Bar as an expert in Immigration and Nationality Law and is on the Board of the American Immigration Law Association (AILA), South Florida Chapter. She is a frequent speaker for AILA and the Florida Bar and supports the Florida Immigration Council endeavors on Cities for Citizenship. Linda Osberg-Braun graduated from Penn State University and the University of Pittsburgh School of Law.

 

She is the recipient of the University of Pittsburgh Marjorie Matson Award for her outstanding accomplishments in helping Haitian and Cuban refugees find freedom and safety in the United States.
