Tap 42 Expansion - An EB5 Investment Opportunity
Tap 42 is a trendy gastropub whose first restaurant is found in Fort Lauderdale, Florida. In 2014, the Fort Lauderdale restaurant had over $7.4 million in sales. Mr. Bernstein has also successfully acquired non-immigrant visas and residency for hundreds of individuals who desired to live and work in the United States and has represented Fortune 500 and large privately-held companies. Roger Bernstein co-founded Bernstein Osberg-Braun PL, a highly respected and widely recognized immigration law firm.

He is a graduate of Brown University and the University of Miami School of Law. He is admitted to practice law in Florida, the 11th Circuit Court of Appeals, and the Supreme Court of the United States and is Board Certified by the Florida Bar as an expert in Immigration and Nationality Law.

Linda Osberg-Braun is a partner and co-founder of Bernstein Osberg-Braun PL, a highly respected and widely recognized immigration law firm. Drawing on her many years of high level government service, Ms. Osberg-Braun valued immigration experience also extends to the EB-5 Investor Visa Program.

Ms. Osberg has counseled investors from many countries on a wide variety of issues in both regional center-affiliated projects as well as stand alone petitions. Her clientele have come from Europe, Asia, Central and South America.

Linda Osberg-Braun is Board certified by the Florida Bar as an expert in Immigration and Nationality Law and is on the Board of the American Immigration Law Association (AILA), South Florida Chapter. She is a frequent speaker for AILA and the Florida Bar and supports the Florida Immigration Council endeavors on Cities for Citizenship. Linda Osberg-Braun graduated from Penn State University and the University of Pittsburgh School of Law.

Common Questions Asked
Are there particular conditions to obtain a Green Card?
The candidate needs to be an accredited investor with the requisite net worth and capital in compliance with USCIS regulations. An accredited investor has a net worth or joint net worth, jointly with his/her spouse, in excess of $1,000,000, disregarding possessions such as homes, furnishings, and automobiles.

By preference, an accredited investor has a yearly adjusted gross income in excess of $200,000 through the last two full calendar years (or joint income with his/her spouse in excess of $300,000) and realistically anticipates to have annual income in excess of $200,000 (or joint income with his/her spouse in excess of $300,000) during the current calendar year.

Furthermore, the investor must prove that his/her assets were legally obtained through a genuine business, salary/compensation, certified investment, property sale, gift, inheritance, loan or other legal incomes.
Are there other basic conditions?
The applicant also needs the proper vaccinations and no identified communicable diseases.

Additionally, the applicant can apply for an EB-5 Visa if they have been previously denied or terminated by USCIS for other visas except if the denial was based on immigration fraud or other legal problems.

The applicant is not required to speak English or to have a sponsor.
How long is the processing time to receive the Conditional Green Card?
Once the I-526 Petition is approved, the estimated time for a foreign investor to be successful in the US Consular interview and to obtain his/her Conditional Green Card is roughly three to six months.
What is the permanent Green Card road map?
The Conditional Green Card terminates two years from the issue date. The foreign investor must submit their I-829 Petition during the three months prior to the Conditional Green Card expiration.

Once USCIS accepts the I-829 Petition, the foreign investor, spouse and any unmarried children under the age of 21 will obtain a one year extension of their Conditional Green Cards. The investor and his family will receive Permanent Green Cards in roughly 18 months from filing the I-829.

Yes, in fact we actually ARE American Life Investments LLC doing business as EB5 for Florida Regional Center. In 2016 we rebranded the Regional Center to highlight our emphasis and strong involvement in the EB5 Investor Visa Program in Florida. EB5 for Florida Regional Center is our trade name and derives its legacy from our vast experience and successful track record with EB-5 investors and developers in Florida.

What material and information are mandatory for the I-526 Petition?
The applicant must present passports, employment and business documents, family and police certificates, court/prison records (in case there are any), military records, photographs, financial statements, and all mandatory documents to prove that the funds came from a lawful source such as bank statements, stock certificates, loan or mortgage recordings.
How does an approved applicant preserve their Green Card?
Two essential conditions are necessary to preserve the Green Card. The first is that the applicant not become removable or inadmissible; for instance, being imprisoned of a serious crime.

The second condition is that the applicant not depart the US as his/her permanent residence. Normally, the USCIS interprets an absence of more than a year potential abandonment of a U.S. residency.
What are the advantages given by having a Green Card?
Once five years have passed from obtaining a temporary Green Card, the successful applicant is qualified for US Citizenship. By having an approved Green Card, the applicant can live, work or retire in the US. He or she can also work in or travel to other countries on condition that a US residence is maintained.

A work permit is not required for employment in this country. In most cases, you do not need a visa to travel to and from other countries. 

Children of accepted applicants can remain studying in the U.S. with the same school costs as U.S. residents.
What is a Conditional Green Card?
A Conditional Green Card is a temporary Green Card that stays in force for two years. When USCIS approves the foreign investor’s I-526 Petition, the investor, his/her spouse and any unmarried children under the age of 21 can likewise obtain conditional Green Cards.

After one year and 9 months, the investor has a three-month time frame to file the I-829 application. This application confirms that all mandatory funds have been invested and the 10 jobs needed were created either directly or indirectly.
What is the United States citizenship road map?
The approved applicant and his/her family will be qualified for US Citizenship four years and nine months from obtaining conditional residency.
